Subject: Bylaws Change Proposal: Communications Transparency

It shall be the policy of the LPPa to have open and uncensored communications.

All electronic communications channels of the LPPa shall be open to all LPPa members in good standing. This includes the LPPa web forum, social media, youtube channel, meetup groups, email lists and all other electronic communication channels. No member in good standing shall be blocked or censored for any reason other than the initiation of force or fraud, or the advocacy thereof.

A five person Communications Moderation Committee shall be elected at the annual convention to moderate all electronic communication channels of the party. This committee will function under the same rules as the Judicial Committee. This committee will have the sole authority to moderate all electronic communication channels. Members of the Communications Moderation Committee shall not be qualified to hold voting board positions while serving and until after the annual convention the following year.

It shall be the policy of the LPPa to make membership data available in a timely fashion to qualified individuals.

The following data shall be made available to qualified requesters within one week of a request to the Secretary. Data shall be provided in comma delimited text (.cvs) or Excel (.xls) format. All reasonable steps will be taken to ensure that only authorized users will have access to any membership data.

Membership Roster
A Membership Roster of all current LPPa members shall be available by request by any LPPa member in good standing. This list shall include: Name, county of residence, the member's date of last renewal, and membership expiration date.

Membership & Prospect Database
A Membership & Prospect Database of all current LPPa members shall be available by request by any voting LPPa board member, or group of any ten LPPa members in good standing, for the purpose of promoting Libertarian campaigns or events.

The Membership & Prospect Database shall also be available for the purpose of promoting candidates for the LPPa board of directors.

Other uses for the Membership & Prospect Database may be approved by the board of directors.

The Membership & Prospect Database shall include:
   All current LPPa members
   All current LP members (if this data is provided by the LP)
   All previous LPPa and LP members current within the last 5 years.
   Other prospects that have requested party information

The Membership & Prospect Database data shall include:
   Name
   Complete postal address
   Email
   Phone number
   County of residence

      Attached are two files which detail the Platform Committee's proposed changes.  The first shows a plank-by-plank substitution, which is what we will present to the convention.  The second shows what the complete revised Platform would look like, assuming all the substitutions are approved.  It is our intent to ask to suspend the rules to consider the whole thing at once on the condition that if it fails we would be allowed to go back and present it plank by plank.  We don't want to come away with no change again this year.

       So the plank-by-plank version is our official proposal.

Attachment 1:

                Proposed Plank Substitutions

   “ Free Markets”

EXISTING PLANK: 1. All individuals should be secure in their rights to freely exchange goods and services.
A.   REPLACE WITH: Libertarians want all members of society to have abundant opportunities to achieve economic success.  A free and competitive market allocates resources in the most efficient manner which produces the most wealth and best satisfies everyone’s wants.  Any person or group has the right to offer goods and services to others on the free market.  The only proper role of government in the economic realm is to protect property rights, adjudicate disputes, and provide a legal framework in which voluntary trade is protected.

EXISTING PLANK: 2. All citizens should have equal access to any government protections and services.
REPLACE WITH: We condemn bigotry as irrational and repugnant.  Government should not deny or abridge any individual's rights based on sex, wealth, race, color, creed, age, national origin, personal habits, political preference or sexual orientation.  Parents or legal guardians have the right to raise their children according to their own standards and beliefs.  Government has no power to define social institutions such as marriage or to impose any restrictions thereon.

EXISTING PLANK: 3. Systems of currency, regulation and public finance should be fair, simple and equitable to all citizens.

B.   REPLACE WITH: Property rights are entitled to the same protection as all other human rights.  The owners of property have the full right to control, use, dispose of, or in any manner enjoy their property without interference, until and unless the exercise of their control infringes the valid rights of others.  We oppose all controls on wages, prices, rents, profits, production, and interest rates.  Competing currencies should not be prohibited.

EXISTING PLANK: 4. All individual citizens should have free a
nd equal access to the electoral process.
C.   REPLACE WITH: Article I, Section 5 of the Pennsylvania Constitution specifies that all elections shall be free and equal.  We oppose publicly funded primaries and laws that effectively exclude alternative candidates and parties, deny ballot access, gerrymander districts, or deny the voters their right to consider all legitimate alternatives.  As private voluntary groups, political parties should be allowed to establish their own rules for nomination procedures, primaries and conventions, all of which should be funded by the political parties themselves.


EXISTING PLANK: 5. The legislative process, and the administration of government, should be open and transparent.
D.   ADD TO THIS: Accordingly, all proposed legislation should be available for review and comment at least 5 days before being voted on by the legislature.  Before voting for or against any bill, it is the duty of each legislator to have personally read and understood the bill in its entirety.  Also, all state government budgets and expenditures should be available for review by the citizens on the Internet.

EXISTING PLANK: 6. The limits of government authority should be clear and concise.

E.   REPLACE WITH: Criminal laws should be limited to dealing with violations of the rights of others through force or fraud, or deliberate actions that place others involuntarily at significant risk of harm.  We support restitution of the victim to the fullest degree possible at the expense of the criminal or the negligent wrongdoer.  The rights of due process, habeas corpus, a speedy trial, legal counsel, trial by jury, and the legal presumption of innocence until proven guilty, must not be denied.  We assert the common-law right of juries to judge not only the facts but also the justice of the law.


            “Free Society”

EXISTING PLANK: 7. All individuals should enjoy free and equal protection under the law.
F.   REPLACE WITH: Education, like any other service, is best provided by the free market, achieving greater quality and efficiency with more diversity of choice at lower cost.  Schools should be managed locally to achieve greater accountability and parental involvement.  We support the right of parents to home school their children.

      We favor restoring and reviving a free market health care system, thus achieving higher quality and efficiency with more diversity and lower costs. We support the freedom of individuals to determine the level of health insurance they want, the level of health care they want, the care providers they want, the medicines and treatments they will use, and all other aspects of their medical care, including end-of-life decisions.

EXISTING PLANK: 8. All individuals have a responsibility to respect the equal rights of others.
G.   REPLACE WITH: Individuals should be free to make choices for themselves and to accept responsibility for the consequences of the choices they make.  No individual, group, corporation or government may initiate force or fraud against any other individual, group, corporation or government.  Our support of an individual's right to make choices in life does not mean that we necessarily approve or disapprove of those choices.



EXISTING PLANK: 9. Public policy should always seek to minimize aggression and maximize individual liberty.
H.   REPLACE WITH: We support full freedom of expression and oppose all government censorship, regulation or control of communications media and technology.  We favor the freedom to engage in or abstain from any religious activities that do not violate the rights of others.  We oppose government actions which either aid or attack any religion.

      Libertarians support the right to be secure in our persons, homes, and property.       Protection from unreasonable search and seizure or warrantless spying should include records held by third parties, such as email, medical, and library records.  Only actions that infringe on the rights of others can properly be termed crimes.  We favor the repeal of all laws creating “crimes” without victims.

       The so-called “war on drugs” has failed utterly.  In addition to its huge cost, it has incarcerated millions for victimless “crimes” and easy availability of potentially harmful substances is still widespread.  End the war on drugs.  An amendment to the Constitution was required to empower the federal government’s prohibition of alcohol and the same certainly is true for drug prohibition.



“The Party of Principle”

EXISTING PLANK: 10. Libertarian Party candidates are free to interpret and develop their own policies with respect to this Platform.
I.   REPLACE WITH: The only legitimate use of force is in defense of individual rights — life, liberty, and justly acquired property — against aggression.  This right inheres in the individual, who may agree to be aided by any other individual or group.  We affirm the individual right to keep and bear arms without being questioned as recognized by Article I, Section 21, of the PA Constitution and also the Second Amendment of the US Constitution.  We oppose abridgement of this right through laws at any level of government and oppose prosecution of any person exercising their right to self-defense.

U.   Article I, Section 5 of the Pennsylvania Constitution specifies that all elections shall be free and equal.  We oppose publicly funded primaries and laws that effectively exclude alternative candidates and parties, deny ballot access, gerrymander districts, or deny the voters their right to consider all legitimate alternatives.  As private voluntary groups, political parties should be allowed to establish their own rules for nomination procedures, primaries and conventions, all of which should be funded by the political parties themselves.

V.   Criminal laws should be limited to dealing with violations of the rights of others through force or fraud, or deliberate actions that place others involuntarily at significant risk of harm.  We support restitution of the victim to the fullest degree possible at the expense of the criminal or the negligent wrongdoer.  The rights of due process, habeas corpus, a speedy trial, legal counsel, trial by jury, and the legal presumption of innocence until proven guilty, must not be denied.  We assert the common-law right of juries to judge not only the facts but also the justice of the law.

1.  In the Bylaws, under ARTICLE IX, CONVENTION, Section 1 - Arrangements, append the following sentence:

2.  In the Convention Rules, under ARTICLE IX, AGENDA, in the first sentence delete the following words:

3.  In the Bylaws, under ARTICLE VII. THE JUDICIAL COMMITTEE, Section 2 - Notice, append the following sentence:

4.  In the Bylaws, under ARTICLE VII. THE JUDICIAL COMMITTEE, append a new Section, as follows:

8.  In the Constitution, under ARTICLE IV. ORGANIZATION, Section 5 - Qualifications, Board of Directors and Judicial Committee, append the following:

In the face of evidence that a member of the Judicial Committee has not performed his or her duties with fidelity, that matter must be ruled upon prior to the Committee providing any other rulings whatsoever, and the member shall recuse himself or herself from all Committee duties until such matter is resolved.

9.  In the Constitution, under ARTICLE IV. ORGANIZATION, Section 5 - Qualifications, Board of Directors and Judicial Committee, append the following:

Every member of the Judicial Committee must be demonstrably familiar with the operation of the Party, its rules, and their spirit.  Toward that end, they must have attended at least five (5) annual conventions of the Party and at least five (5) meetings of the Board of Directors.

Announcement of Candidacy 03/09/13

I have been approached by multiple people multiple times suggesting that I should run for state chair.  Since Tom Stevens announced that he will not stand for re-election, such requests have intensified.  I assure you that being chair has just not been on my radar.  Believing that the party needs and can benefit greatly from good marketing, I have felt that area is where I can make the greatest contribution.  The pitch that I hear most often is that I am impartial, not a part of any “faction” and may be the best person to unify our members behind doing the things necessary to become a successful political party.  I have spent a lot of time working for the LPPA (as well as the LP) and I surely do want us to succeed.  So, assuming that the above pitch has some validity, I will run for chair.  I am asking for your support which would be very much appreciated.

Background

Philosophically, I have been a strong libertarian since I was 15 or 16 years old.  I fought for liberty as an idealistic young person before there was a Libertarian Party.  Now I continue that fight primarily for my children and grandchildren.

My college major was pure physics, but my first job was applied physics (engineering) with a large multi-national corporation.  Following that was sales, then marketing management and finally management of a strategic business planning group, all for the same corporation.  Getting into small business, I bought and operated a beer distributorship for 12 years before selling it.  While distributing (or maybe drinking) beer, I founded Intelligent Computer Systems, Inc., which developed comprehensive business software and installed turnkey computer systems for distribution businesses.  After 22 years, ICS was sold to the 3M Corporation.  I am now retired and pursuing a backlog of personal projects.  I also teach economics part time in 11th and 12th grades with the Junior Achievement program.

Recent LPPA Activity

I chair The Marketing Committee and The Media Relations Committee and am a member of The Platform Committee under chair Henry Haller.  The Platform Committee recently posted its proposal for the planks section of our LPPA Platform.  I strongly urge that this proposal be adopted on April 27th.  The Marketing Committee has created “Aids from the Marketing Committee” that can be accessed in the folder of that name on the LPPA_BB Yahoo group.  Several of us on the committee have been working hard to improve the LPPA.org website and convert it to the WordPress framework.  We hope to have the new and improved LPPA.og online in late April.

Three years ago, I chaired a temporary ad hoc strategic planning committee.  I presented the final report at our convention two years ago.  Looking through the PowerPoints and the narrative will convey a pretty good picture of some of my views.  Your attention is especially directed to the recommendations at the end.  (See attachments at the bottom of this post.)

Last spring, I attended the LP national convention; collected nominating petition signatures for Governor Johnson and our LPPA statewide candidates; helped validate signatures using the VIDAS tool; and helped file the petitions with 39,000 signatures in Harrisburg.

When Republicans challenged our signatures last August, I volunteered to recruit, schedule and expedite the 84 volunteers who helped us with signature validation.  I helped our marvelous legal team train and supervise the volunteers.  I rehabilitated petitions containing thousands of signatures that the Rs had challenged on technical grounds.  For me, this turned into a full-time, 7-days, 9-week project with two weeks of it living out of Philadelphia area motels; over 4,000 emails and ‘phone calls were handled.  Ultimately, this colossal team effort handed the rotten Republicans a total defeat and serves as a terrific example of what can be accomplished when we actually do work together.

Pledge of Fairness, Impartiality and Transparancy

I pledge that, if elected chair, all LPPA proceedings and business will be scrupulously fair, impartial, businesslike, respectful and transparent.  This has always been my policy in dealings of any kind, LPPA or other.  I hope and fully expect that those who know me will confirm that to be true.  I brought this matter up at the December 1, 2012, board meeting to emphasize the importance of adhering to these obviously important principles.  As can be found in the minutes of that meeting, I introduced the following resolution which passed unanimously: “All LPPA officers and board members are committed to the open and transparent conduct of all LPPA business.  Consequently, all interested LPPA members in good standing are encouraged to join the Yahoo LPPA_BB Board Business group for the purpose of monitoring the board business discussions conducted thereon.  Similarly, interested LPPA members in good standing are welcome to attend scheduled Board of Directors meetings for the purpose of observing the functioning of the board.”

Conduct of Campaign

I deplore the personal attacks and in-fighting that occur all too often for reasons I have difficulty understanding (immaturity?).  Such behaviors waste our limited resources (time, energy, patience), serve to divide us when we need to be united and are downright self-destructive.  They also tend to repel new members when we need to attract them.  I have always tried to tamp these things down and have often pointed out that we libertarians frequently are our own worst enemies.  Win or lose, this campaign will not tear down any other libertarian and will not engage in scurrilous allegations or unsubstantiated innuendo.  It will focus on what I would do to build our party going forward.

LPPA Future Direction

It is critically important that we focus our limited resources on replacing crappy politicians with good libertarian citizens.  It’s a mistake to dissipate resources fighting a bunch of issues; if we get good people into office, they will fix the issues.

In order to elect libertarians, we need a successful political party that is based on libertarian principle.  That has to be our goal.  We don’t need a club, fraternity or a debating society!

Almost the only thing important to the success of a political party is membership.  We don’t just need a 50% or 100% increase in membership.  We need to think in terms of increasing it 10-fold, 20-fold and eventually even more.  Growing disgust with the old parties gives us the best opportunity we have ever had to accomplish that.  Let’s not blow it.

The best way to capture new libertarians is to do a good job of marketing our fundamental principles.  Many people will agree fairly quickly with our principles.  But we need to recognize that it takes some time for most to evolve into accepting the full application of libertarian principle to all issues.  The LPPA needs to be a welcoming incubator for new libertarians where we help them evolve, not deride or reject them for being “imperfect.”

A few more specific things the LPPA can do are:

    •   Complete development and optimization of the new LPPA.org website.  This is a key tool.  Test the use of Google AdWords and other technologies to drive new traffic to the site.

    •   Instead of just an Eastern Vice Chair and a Western Vice Chair, change our structure to have six regional vice chairs.  A primary duty of a vice chair is to develop and assist county committees.  It’s ridiculous to expect one person to cover 33 counties and half the state.  A sixth of the state and 11 counties would work much better.

    •   Set up a few trained speakers dispersed around the state and make an organized effort to book them speaking engagements wherever possible to explain/promote libertarianism.  The Marketing Committee could develop a PowerPoint presentation that speakers can optionally use.

    •   Collaborate with the PA Ballot Access Coalition to organize an intelligent lobbying effort to see if the Voters’ Choice Act can be passed this legislative session.

    •   Move the annual LPPA convention date earlier (either the third week of March or the weekend nearest the end of November).  Have final nominating petitions ready and volunteers organized to collect signatures at polling places on primary election day.

    •   Conduct a study and compile a list of the easiest-to-win local elections and make serious efforts to recruit good libertarian candidates for them.  Offer marketing support to candidates.  Concentrate resources from surrounding areas and possibly the state to help them win.
